Proposition 65 Residential Rental Property Exposure Warnings Regulation (the “Apartment Regulation”) will take effect July 1, 2019.  This regulation, and Proposition 65, apply only to businesses with 10 or more employees.  The Apartment Regulation allows landlords to provide Proposition 65 warnings in the lease rather than by posting signs throughout the property. This regulation was developed at CAA’s request, since the general Proposition 65 Safe Harbor Warning Regulation (effective on August 30, 2018), which applies to all “person(s) in the course of doing business,” did not provide for compliance methods that worked in the rental housing context.
